These Terms of Service ("Terms") govern your purchase and use of the Rack Detector desktop application ("the Software"), developed by Elevation Technology Solutions ("we," "us," "our"). By downloading, installing, purchasing a license for, or using the Software, you agree to these Terms. If you do not agree, do not use the Software. Questions? Email elevationtechnology@outlook.com.
The Software is free to download and evaluate for up to 10,000 sorted images. We strongly encourage you to use the free trial to confirm the Software meets your needs and runs at an acceptable speed on your own computer before purchasing a license. Continued use beyond the free trial requires a paid license key.
Rack Detector runs dramatically faster on a computer with a compatible NVIDIA GPU. On machines without a supported NVIDIA GPU, the Software runs on the CPU only, which is significantly slower — often many times slower. This is inherent to the AI models the Software uses and is not a defect. Processing speed depends on your hardware, image sizes, and batch size. Because speed varies by machine, please use the free trial to measure performance on your own hardware before buying.
Payments are processed by Stripe; we do not receive or store your full payment-card details. License keys are typically delivered by email within 24 hours of purchase (usually sooner).
All sales are final and license keys are non-refundable. Because the free 10,000-image trial lets you fully evaluate the Software — including its accuracy and its speed on your specific hardware — before purchasing, we do not offer refunds. If your license key will not activate or the Software will not run on a supported system, contact us and we will work with you to resolve it.
Rack Detector uses AI models to detect and classify wildlife. Automated classification is not 100% accurate — some images may be sorted into the wrong folder, and you should review the results rather than rely on them as definitive. We are not responsible for decisions made based on the Software's output.
The Software processes your images entirely on your own computer; your photos are never uploaded to us. See our Privacy Policy for what limited information is collected during license activation.
The Software is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Software will be error-free, uninterrupted, or that it will run at any particular speed on your hardware.
To the maximum extent permitted by law, Elevation Technology Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Software. Our total liability for any claim relating to the Software will not exceed the amount you paid for your license.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Software after a change constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules.
